what essentially is the difference between the 2? I've recently locked up a price with an owner on a FSBO, and now i have to bring forth the contract. problem is i dont know which one to use or what the difference is between the two. I'm also looking to add an additional term on the contract "earnest money due within 10 days of acceptance or this contract is null and void". this term buys me time to come up with earnest money from my buyer and also gives me an exit strategy in case i cant find a buyer. The problem is only the Purchase and Sale Agreement has the "Additional Terms and Conditions" line, whereas the Purchase Agreement doesn't. Which one should i present to the seller?

Use the Purchase and Sale Agreement has the "Additional Terms and Conditions" line, since you need to add clauses in it. There's no real difference between the 2, just use the one that makes more sense to you.
