Do you get your earnest money back if you dont sell the property even if the contract doesn't state yes or no.

within the "Due Diligence" timeframe

On every purchase contract you will have a "Due Diligence" and/or also referred as "Inspection Period" timeframe. Normally it will be between 5 - 14 days. This is your (or your Cash Investors) time to inspect the property. If you back out of the contract within that timeframe then yes, you will get your full "Earnest Money" back. If you go past that deadline and then back out of the contract then the seller keeps the "Earnest Money". Be very careful and watch your deadlines that are outlined on the purchase contract.
