I have a family member that asked her tenants to move and even had her attorney give them papers to move in a month when they said no.
Problem is they are not moving.
The thing is she is a senior citizen and from italy and doesn't speak great english. So she went to a REA to rent her basement which is actually illegal. He brought 2 people in and then the husband showed up later on. She has no paperwork/ lease agreement with them. Is there any way she can evict them quicker since there is no lease? Her house needs foundation work but she cannot do it with them in there.
Any one with experience please reply.

she has to go through the process to get the sheriffs to evict them through the court. She may not of had a lease agreement (paperwork) directly with the tenants but she had an agreement with them to lease out her basement through the REA that she use. Have her get in her possession whatever paperwork the REA (whom she use to find the tenants) has in his possession. They (tenants) had to sign a lease agreement through him to rent out her basement, if he had them do that. Understand what I'm saying, there's a trail of paperwork somewhere. God Bless with getting this all resolved.

Proper background checks are very important in preventing these type of situations from occuring. I had to evict one of my tenants and I lost $3K and had to pay the lawyer fee's, etc. As a result of this experience, I decided I would never deal with tenants again and decided I would hire a property manager. Since hiring a property manager, I have had no problems.

The best way to approach this is threw the courts. Even though there is no lease, tenants still have rights. So from your stand point, making sure you follow procedures for eviction would be wise. As far as the repairs. In my state you are only required to give notification 24hrs prior to entering. So I would send a notarized letter and have the official assist in entering if they refuse. Especially if the problem can endanger someone. Since they are seniors, is there assistance available threw social services that can maybe communicate with them better? Maybe help place them else were? Do they pay on time? Even though they are tenants, just remember they are seniors! So be cautious and handle with care. So let me get this straight the REA didn't have them (tenants) sign any paperwork at all. He just brought them over there to your family members place. *raise eyebrow look* What did he collect from them money wise before possession of space was turn over to them? I'm going to help you get to the bottom of this! What referral fee did she pay him for bringing in the tenants? What she has to find out, is when?, what date did they agree on that the lease would expire? I find it unethical that the REA didn't get any paperwork sign between her and tenants. If I were her, I would look into filing a complaint against the REA.

Lubertha, my family members are the senior citizens. the renters are not. Either way I think the best way to go is of course legally. I think I will pay a visit to the REA to see what I can get out of him. I called a friend who is a US marshal to see if he can do something, but he is not sure when it comes to RE.

I would question the agent in the presence of his or her broker. It sonds like the broker was not aware of this transaction, since there was no paper work. In most states as a agency, you are required to keep a records ab a broker for a certain period of time. Contined success.............Lubertha
