Is any out there doing deals in Texas? I had a real estate agent tell me that TREC (Texas Real Estate Commission) forms/contracts can only be utilized by licensed realtors. Anyone have any info. on this?

Contracts in Texas

You may want to use a generic or investors contract when dealing directly with the seller. They are shorter and less intimidating when you are dealing directly with the seller. You can get copies of state contracts and there are free investor forms available as well on www.totalrealestatesolutions.com.

Using Contract in Your State

You may be able to use the contracts on the website above but if you decide to you will want to have them checked by a competent attorney in your area. Your state will have created or accepted a contract that is generally used by Realtors and can be used by you. A Realtor, title company or closing agent should be able to get you a free copy of the "accepted" contract in your area.

So it all goes back to an attorney. I guess I will just have to find an attorney to write me one. Texas Real Estate Commission contracts can only be used by licensed agents in Texas.


Not true... Investors, and

Not true... Investors, and plenty of them use TREC contracts... You just can't hold the TREC liable if you misuse the contract or get sued and lose.

All real estate companies have their own contracts written with their company in mind.They are written by attorneys and are approved by the State Board of Realitors. That is why you cannot get a blank contract from a real estate company. But, you can get a generic "long" form from a title company. It will still have all the contengencies but will not be directed to a specific real estate company.

True some Realtor groups may have their own contracts but for a mass majority of the states the state itself dictates what can be used on the contract. Some states dictate which contract to use and only that contract can be used. The key is to talk to a Realtor and get a contract that is specific and useable in your area. Title companies will often have the same contract that a Realtor will have and they don't put up as much stink about getting the contract.
