Marketing without a contract?

Does anyone know if it is legal to market a property without a contract? If I am partnering with another wholesaler and don't have a contract with the seller myself, can I market the property on my website, craigslist, etc? I know this is a question for my RE attorney, but I thought maybe some of you probably already have that answer. Thanks!

Are you receiving a finders

Are you receiving a finders fee?...cause there got to be something in there for you right? I would get a finders fee contract signed first with the wholesaler stating how much my cut is. When you get that signed, then, I think, you could go ahead and market the property but I'm not sure if you can publish the exact address. You could advertise the street name, city & state but not too sure about the # to the address. You could ask your attorney what he thinks about what I just said and hear what he says. Hope that helps.

I will be getting a finder's fee for finding the buyer. We have a verbal contract, but nothing in writing.

Funny you ask this, just the other day I met with my attorney to go over some items and he just happened to ask me, "How do you intend to find buyers for these properties you intend to Assign" and I replied, "well I already have ads on CL advertising the property". He quickly squinted and made a funny face and stated, "I dont know about that one". He went on to say that "until there is a contract you are walking a fine line of brokering a property, when first of all your not licensed, and second of all you dont have a contract with the seller yet. Get it under contract then market."


A verbal contract will not

A verbal contract will not work. I'm not even sure about what I said above will work but you have a greater chance if you have a contract signed.
