The SAFE Act is about ready to be put in action. This law unfortunately will probably affect me and my company but probably not individual investors who are doing just a couple of transactions a year of seller financing.

Am I correct in interpreting this in that it will not affect us in doing L/Os since we are not doing seller financing?

And as long as our seller is not selling more than five props per yr in this way, still OK. Right?

the lease option process seems to be okay since a titleable interest is not being transferred.

The new rules, however, are not setting a minimum threshold on the the number of deals. Instead, the law is allowing the states to determine their own demarcation line.
