How to Get Rid of Deadbeat Tenants

Dear Forum:

I have some tenants who are consistently late with the rent, pay partial rent, or don't pay at all. This plays havoc with my cash flow.

I would like to get rid of them, and have served three 3-Day Notices so far.
However, they have filed bankruptcy and have told me that their attorney says I cannot evict them legally, unless the bankruptcy attorney says so.
Which is a $3,00 - 4,000 process.

Does anyone have any suggestions on how to handle this?

Hey, TRSD, thanks for the link!
I may have to go down the legal path, but I am trying to avoid spending thousands of dollars.

An attorney suggested I offer them $500 to leave voluntarily, thereby saving money (after I get over the digustingness of it all).

Any other ideas, Forum?

Try reasoning with them...

I would tell them that you don't want to evict them because it will be difficult for them to rent other places, but that you need to get paid in order to pay the mortgage of the property (whether you have a mortgage or not); otherwise the bank will foreclose on your property...

as your attorney suggested, you can offer them 'moving' money if they leave the place clean and without any damages... I understand how sickening it is to have to reason with your non-paying tenants, but it's worth just to get your place back and get paying tenants in it...

I have approached them with some of what you suggest, but more can be done along those lines.
It looks like they can't really do it, though (pay the rent), so I probably having to offer them moving money.

It's just too hard to try to live with all this financial insecurity.
