Late on his rent, again..what to do?

We have a house that was rented to a couple that has recently split..now he lives in the house and he has sent the last few rent check (late by a few days). the rent is due on the 1st. Last week he emailed and said he had an accident and didn`t have the money, But would send it when he got paid last Thursday (5th)..still no check in the mail..I emailed him yesterday (8th) and asked if the check was in the mail yet and he hasn`t replied..I know he gets his email instantly on his iphone. so he is ignoring me..The lease is up Sept 1st and he obviously can`t afford to live there, so we could get him out by then, but in the meantime...what would you do?...send him a registered letter? cancel his lease and give him 30 days?..I have never charged him a late fee, but it`s in the lease (10%)..give it to a lawyer?....I need sage advice so I don`t do something wrong, or just get myself into trouble..

First you have been..... Very generous and considerate and it's apparent that his income has greatly reduced but this is a business.... You have made attempts to contact already I would do the registered or sign required letter an see if he would response but I wouldn't wait I would speak to my lawyer and see one what are the tenant rights if the eviction process would be to begin and secondly I would start it anyways because if the court gives any time you will loose that time plus the time between this post and then

3 Day Notice!

Bodeen,

first, you need to read his lease and follow what it states. If tenant owes 10% late fee after the 1st (?); then you write a letter and let him know that his rent is late and that he needs to pay immediately and include the late fee (state amount); also, you can state that if he continues to pay late, it will be best if he moved out, because you have financial obligations to meet with regards to the property that he is renting from you, and you can't afford having a tenant paying late.
If you don't receive the rent or hear back from him within 24-48hrs, I would post a 3 Day Notice to pay or quit on his door, or mail to him registered mail with signature required. You can talk to an attorney, and they will create the 3 day notice for you for a fee, and start the eviction process for you after the three days elapsed.

30 day notice

I know this is a business but it all depends on how good of a tenant he was before the split. Did the rent always come on time? Did he ever have a excuse? Life happens and if the split is the cause of him not paying the rent then you need to give him a 30 days of notice to leave. And if he takes longer to leave sit down and talk to him and offer him money to leave. Think bout it if he stays there dodging you and living rent free until the eviction process goes through you will lose more money on possible rent than just giving him lets say a months rent to put down on another house/Apt to move to.

Landlord Solutions

In the State of Washington, we have Landlord Solutions. When I have any issues with a tenant, I call them. They know the laws and get it handled as quickly as possible. It does have a cost, however, so does a deadbeat tenant. I'm not saying that your tenant is, but this is a business. Check your YP.com for a service of this type. It has saved us a ton of headaches. We found that when you give an inch on the rules, including not charging late fees, etc. a tenant will take a mile and believe me THEY know the tenant laws even if you don't! We use a property manager and find that is also very helpful with trying to keep it a business! If you have more than one property, you may be able to get a lower rate. It is well worth the money! We are all in favor of being nice, but you did state that it was obvious that he could not afford the rent. If they communicate, that is one thing, but when they avoid contact, it is obvious that you need to take action. Sometimes even nice people have difficult situations, but that is not our business.....move on and let him move on to a better situation for both of you. Best of luck.
