Hey There to my DG Family... Hope everyone is doing good. It's good to be back! My computer was out of commission for 3 weeks or so, and I felt lost. I stay busy taking care of my Handyman Business, but this is where my heart is at, Real Estate. Once again hope everyone is doing good! 2010 is a new year with a lot of new goals in peoples lives. Stay Focus, Stay Involved, Stay Proactive, Continue to network with people daily, search for that insight and success & prosperity will find you. In the beginning you might feel a little hesitant, overwhelm, and may be disappointed or even scared that you might fail, but you are doomed if you don’t try. The future belongs to those who believe in the beauty of their dreams. When you feel like giving up, remember why you held on for so long in the first place. Between you and every goal that you wish to achieve, there is a series of obstacles, and the bigger the goal, the bigger the obstacles. Your decision to be, have and do something out of the ordinary entails facing difficulties and challenges that are out of the ordinary as well. Sometimes your greatest asset is simply your ability to stay with it longer than anyone else. Never consider the possibility of failure; as long as you persist, you will be successful. The Real Estate Council of Alberta has received advertising regarding your pre-auction event in the Province of Alberta of properties foreclosed by Citibank and the Bank of America in the United States of America. The pre-auction event is advertised as “The Insider’s Edge”. Participants in the event are to put down a deposit to acquire a foreclosed property. This seminar is being offered in various Alberta cities. The information in the advertisement indicates that you may be trading in real estate as a real estate broker without the required authorization.

The websites related to your program reviewed by RECA do contain contact information. RECA has left messages with the your booking service and your customer support center. RECA has also sent other e-mails to Dean Enterprises as well as dgadmin @ deangraziosi.com. RECA has not received a response. Given RECA’s inability to contact you, RECA has resorted to communicate with you through these forums.

You are not authorized to trade in real estate in the Province of Alberta and if you are trading or intending to trade as real estate broker without authorization you are expected to cease all such activities until you become authorized. Please contact me as soon as possible to discuss this matter.

Trading in real estate as a real estate broker without authorization in the Province of Alberta is an offence. The Real Estate Act provides for fines up to $ 25,000.00 per transaction against the corporation and any officer and shareholders. The corporations and all officers and shareholders are also required to return of all commissions received.

(x) “trade” means
(i) a disposition or acquisition of, or transaction in, real
estate by sale, purchase, agreement for sale,
exchange, option, lease, rental or otherwise,
(ii) an offer or attempt to list real estate for a disposition
or transaction referred to in subclause (i),
(iii) assisting or offering to assist a person in disposing of,
acquiring or entering into a transaction in real estate
referred to in subclause (i), other than through a
listing, in circumstances in which that person pays a
fee or other consideration for that assistance,
(iv) collecting, or offering or attempting to collect, on
behalf of the owner or other person in charge of real
estate, money payable as
(A) rent for the use of the real estate, or
(B) contributions for the control, management or
administration of the real estate,
or
(v) any act, advertisement, conduct or negotiation,
directly or indirectly in furtherance of any activity
referred to in subclauses (i) to (iv).

Authorization required
17 No person shall
(a) trade in real estate as a real estate broker,
(b) deal as a mortgage broker,
(c) act as a real estate appraiser, or
(d) advertise himself or herself as, or in any way hold himself
or herself out as, a mortgage broker, real estate broker or
real estate appraiser
unless that person holds the appropriate authorization for that
purpose issued by the Council.

Offences
81(1) A person who contravenes section 17, 18(1), (2) or (3), 19,
20(2), (3), (4) or (5), 24(1)(a), 25(1), (2), (3), (5) or (9), 26(1) or
(4), 29(1) or (2), 33(2), 35(1), 69(2), 73(2) or 74(2) is guilty of an
offence and liable to a fine of not more than $25 000.
(2) Where a corporation commits an offence under this Act, any
officer, director or agent of the corporation who directed,
authorized, acquiesced in, assented to or participated in the
commission of the offence is guilty of the offence and is liable to
the penalty under subsection (1), whether or not the corporation has
been prosecuted for or convicted of the offence.
(3) A person who is convicted of an offence under section 17, 18,
20, 24 or 25 shall, in addition to any fine or penalty payable under
this section or section 83, return all commissions and other
remuneration received by that person in respect of the activity that
constituted the offence.
(4) A prosecution under this Act may be commenced within 3
years after the date on which the offence is alleged to have been
committed, but not after that date.
