I already own a home and it is now for sale and have a contract on it. I want to find a lease purchase but really don't know how to ask the owner a question about the clause that is supposed to say about being able to re assign. I am afraid the original owner will say no way this is supposed to be your home not someone elses. Or should i keep the lease purchase home and not re assign it to someone else? I had the same problem a few weeks ago with a lease option I was getting. I wanted to get it and then resale it to my nephew and his family.
I negotiated every clause on the contract to the point where the owner got what he wanted and I got what I wanted. I told him I would like the assignment clause in there, when he questioned it, and I just flat out told him why. But I made him understand that he would still e selling it even it was not to me, the contract was still valid and in effect. He went with it and I got the property and put my nephew in it on a one year lease with purchase option at end of 1 year.
Also on the lease portion of the agree do not forget to geet the sublet clause in there.

Well Anita guess what? I did have a contract, but oh gosh always something. The people that had a contract on my house freely got out of it due to a death in there family and they have to locate to Texas. I guess i am back to the drawing board. So close but not close enough. Now what do i do to still move? I am afraid to do a lease purchase, what if my mortgage broker says i can't do a lease purchase? Any ideas Anita? Please help. Cindy.

Hi Anita, I would rent it out but i called my realtor and in this area homes in my subdivision are only renting for 1,200 to 1,300, and i wouldn't be making anything. Just breaking even.

First - your broker cannot tell you if you can do a lease purchase or not. That is your decision. I am sorry to hear about what happened to the house but just keep looking. Go to CL and place an ad under PROPERTY WANTED and see what you get. Start asking around ask church, friends etc and see if they know of something.
Are you trying to move to a bigger house for yourself? If so maybe you should look for a trade. Someone with a larger house that may want to trade down to a smaller one for financial reason. Put your thinking cap onn and you can do it - find something that fits you.
