Is doing assignments in Arizona legal?

Yes.

Often the question of legality comes from Realtors. Realtors feel that what we do is acting like a Realtor without a license. What separates us is that we sell items we own. If I own a home I can sell it without a license. If I put a property under contract I own what is known as the equitable rights or equitable interest in the contract. When you do assignments of contract you are selling these rights and not the home. This is what make what we do legal. The states that have the most difficulty are California and Texas. Even with this each of those states have an ability to do something similar to an assignment of contract.

Try a Double Close

If Assignment of Contract doesn't work in any area you can always do a Double Close. This is when you buy the property using Transactional Lending or Flash Funding. These are very short term loans from 1-3 days. This way you can close on property and then sell it to your buyer. These companies will need to verify that you really have a buyer that can and will close within the time allotted. A company you can check into is www.coastal-funding.com.
