Needing some Helpful Answers and Info

Hi all. My partner and myself were riding properties today, when we came across a property that is currently listed with Caldwell Banker. While I was sitting in my vehicle writing down the info on the home, a gentleman walked up and checked the mailbox and proceeded to go into the backyard of the home. When he came back to the front of the house, I quickly asked him if he knew what was going on with that house. He was like an open book, and said "YES I know everything about this house". He began telling me that the owners of the home had both passed away within 9 months of each other. The kids all live out of town and want no part of the house; they just want to get rid of it. He also told me that they wanted $108,000 for the property, and gave me the sons phone number. The home has just had painting and some renovations made. All in all the home looks to be in very good condition. My question is, can I deal directly with the son since they have a broker listing the home for them? Also, we would like to try and wholesale the property so I was also wanting to know what kind of contract would be appropriate to assign this property.
OK, there's my story of hopefully my 1st deal in the making lol. Any help or advice would be greatly appreciated. Charles

Answer to questions

You will need to deal with the listing agent on the property. They are paying the agent to work with people looking to buy the property. With it being listed with an agent will have to use an agents purchase contract to make an offer on the property. Make sure when the contract is filled out you have what you want in the contract, like this contract may be assignable. This sounds like the perfect property to work with. Good luck.

Great job getting out and talking.

You have to go through the agent while its listed, but,
You can contact the sons and let them know(after you run the numbers and know its a deal)that you're intersted in the property and if they don't have any luck selling after the listing expires to call you or ask when the listing expires. Just tell them you don't like dealing with realtors. Explain how you can save them money and time.

Why was the man you spoke to there and how did he know so much?? Vacant house?

Theoretically,

you could send the offer to the son BUT the agent will be getting his commission from the transaction, and that will need to be figured in your calculations. However, at least you will know that the son actually received your offer and it wasn't shelved by the agent. (Yes, that does happen)

You wouldn't expect the REAgent to submit a low offer and reduce his/her commission would you?....even though it happens all the time and even more so with REO offers.ETHICS?

Thanks for your advice

The guy that I talked to actually lives next door, and has known the family for years. The property is currently empty and he is maintaining the property since the rest of the family lives out of town.

sounds like you got a winner there! people who live out of state don't want to have to deal with vacant properties, and pay taxes.

If you talk to the listing agent, you my have some room to negotiate, since you won't be bringing in another agent to split the commission...
