Basement Rental Question

Hello to all, my question is a lease or any type of paper work should be used only to set up guidelines on specific terms I wish to address in writing. HOLD ON the tenants are close family members, that is the ONLY reason I have allowed them to consider the basement.

ps: They insisted in the basement because it is much cheaper to rent any top floor apartments.

Lease

I would definately say that any agreement you make with anyone (and in some cases ESPECIALLY family) should be in writing! This will lay out all of the specifics of your deal, how much monthly was agreed to, when the lease payment is due and how long the lease is for. Also, IF ANY PETS ARE ALLOWED...ECT. The list goes on and on and if you do not get this in writing some people have memory loss as to what was agreed to verbally. Please always protect yourself!

Make sure that it is

Make sure that it is legal,in most states you must have two common egress and one in each bedroom. So make sure that is permitted in your area.

Since your basement is probable not a legal residence for you to lease, and any lease you use will most likely not be legally enforceable, you could just copy and paste any portions (you may think necessary) of a standard lease and create a simple lease for you and your family renters; just so that you would have a written agreement to avoid any future misunderstandings between you and your family.
Definitely a good idea to have it in writing!
