Brokerage Agreement with RE Agent includes FSBO's???

DG Fam,

I didn't think you had to use your agent with FSBO's, so why did the brokerage agreement state that I have to contact the agent if I am interested in one? Is that necessary? Would I get in trouble if I didn't use them and they find out about it, especially if were using the same attorney for closings?

Hey Bernard,

if an agent wants you to sign a agreement the best thing you can do is run, far and fast. You are not marrying the person. You are giving him a chance to earn some money, always remember that. If you sign some sort of an exclusive contract you are stuck with that agent whether he performs or not. If he or she is good (s)he doesn't have to worry about you trying to use somebody else.

Have at it and don't take any crap from anybody.

Exclusive rights contract

Every agent would try to lock you in a contract with them to buy any property off the MLS, you don't have to sign this contract with them. All you have to tell you agent is that your an investor and you invest in different areas and you use different agents for different areas. I tell this to every agent I had worked with and the 2 I have now, I never had any of them tell me otherwise. Also even if you did sign the agreement, the contact is for MLS properties only, you can go buy how many FSBO's as you want without your agent.
