I need help with Florida Real Estate assignments!

I have been talkin with many real estate experts (so they claim) and they are sugesting that it is illegal to assign a Real Estate contract in the "sun shine" state.
If you are a real estate investor in Florida I would like to get your input on this.

Ask the so called experts

to show you where it says it is illegal. Most ignorant people talk before they actually understand the situation. They are attempting to confuse selling a property you don't own with assigning the accepted contract that is buying a property. Most experts try to protect their own turf with a bunch of myths or scare tactics or uninformed opinions. Just stay the course and assign at will.

I have had offices in Florida (O-town) and Ohio for the last 6 years. Most of my property transactions have been in Florida (the entire I-4 corridor) so I know FARBAR usage and I am pretty well versed in FL real estate law. BUT I AM NOT AN ATTORNEY! However, please talk to a real estate attorney who can guide you in this economic climate.

The basic problem is that real estate agents **** and moan about other people using creative techniques as most of them are not versed in real estate investing. They think someone is stealing food from their mouth. This always appears when the market is hard as it is easy to **** and moan instead of working hard. This doesn't mean that they don't have a point in some limited situations as some investors do cross the line.

However, if you ask the real estate agent to point you to the part of the statute that you are breaking; most won't have a clue and you will see their agenda. But you must also be cognizant of the laws and not set up a transaction that crosses the line. Good luck.

I never looked at it that way...

..but you have a point, many Realtors around here claim that a bird dog would be illegal LOL, that I know is not true, they claim you have to have a liscense in order to receive any compansation.
I'm getting more involved with REI as a matter of fact I have already joined a local club, well not so local it's in Fort Myer.(35 minutes away)

I used to live near Orlando in Howey in the hills I'm sure you never heard of it, it's a small town 45 minutes from O town, and I spent most of my weekends in Orlando. Small world!!

Are you still doing business in Florida Bill?

For what it's worth.......

Hi Luiz:
I am also in the Sunshine state up in Polk county. I've been told by an attorney in my REIA group that it is legal to assign here in FL because you are not selling the real estate in the contract, you are selling your "rights to" and/or "position in" the contract. Have a contract lawyer explain the difference for you.
AS for a bird dog fee, the investors in my REIA club have told me that in order for a bird dog" fee to be added to the HUD 1 statement, you would need to have a license here in Polk county. You may want to confirm this with your local county officials using the term "Selling Information" (not real estate) as your business then clarifying with "So if I told someone about a house for sale... etc. if the answer was "no license required."
As for your local REIA club being 35 mins away, I wish mine were that close! LOL I go to 3: 1@ 50 Miles away, 1@ 63 miles away and 1@ 95 miles away. And those are just the 1 way miles, double them for round trips. Be glad yours is only 35 mins. LOL:D
