RE: What contract too use

Hi,
I realized when I posted,I was not to the point! My post should of said:What are these contracts for.
(1)Agreement to Purchase:detailing a sale of property, including price and terms/This sounds like an offer too me.
(2)Assignment of Contract:transfer of rights held by one party to another party/This sounds like making sure you get paid for the rights you hold.
(3)Purchase and Sale agreement:This would be the contract/Real estate contract/SALE
Please forgive my first post and what do you think about the info I have posted!
Thanks for looking!!!

(1)Agreement To Purchase It's essentially a purchase agreement between the buyer and seller.
(2)Assignment of Contract Yes this is contract you and your end buyer would sign agreeing they will uphold the terms of the contract sign between you and the seller. Oh and pay the agreed upon assignment fee. You'll also want to get them (sellers) to sign the other form mention in Dean's BARM. Discharge of Seller's Agreement just alittle something extra to cover yourself once you assign the contract to another end buyer. I know its use in IEE, but I always say a little extra goes a long way.
(3)Purchase and Sale Agreement Same as Agreement to Purchase its wording is alittle more self explanatory. Any P/S Agreement you present to Seller is just that an Offer until both parties agree to the terms of the contract.

Contracts

Hi Rosefield,
Agreement to Purchase is just that, however some States require this document to be signed by all parties before a Purchase and Sale Agreement can be entered into and closed upon.
Assignment of Contract is a method making money in real estate without you buying or selling real estate.
Purchase and Sale Agreement in most States is the instrument that Sellers and Buyers use in a real estate transaction.
I hope that helps.
Tom

Hey,
Alana I am getting alot closer,Thanks too you! tflood(coach)Agreement to purchase sounds like an Offer statement and Assignment of contract is basic:transfer of ones Right, Purchase and sale, feels like the contract- any would put And/or assigns because you have the sale agreement!
I really do not know and most of ALL...Thank-You for bringing me closer.
One more question/Is the Agreement to Purchase...The template for making an "offer"(I am not talking verbal)
It really means ALOT too me,For your time and INFO!!!

Robasciotti

You need to use a Purchase and Sale Agreement,Read the contract as it will be self explanitory.Your seller will sign on the Sellers line and you will sign on the Buyers line, make sure you put and/or assigns after you sign your name on the Buyers line example ( John Dow and/or assigns ,as Buyer.then use an Assigment of contract with your Buyer, that contract will also be self explanitory. Hope this helps.

Locking it down

Hello everybody,
I know it all depends on which state you are in,I came up with...
Agreement to Purchase-I would sign with the seller,Locking it up
Assignment of contract-I would sign with my buyer
Purchase & Sale Agreement-Buyer would sign with the seller at closing

Do i have this correct? I am also off balance when people say to get a
Purchase & Sale Agreement signed when locking it up or does it really
matter.

Last and final question-When it comes to writing And/or assigns or is it
And/or assignee? assignee sounds better.

Thanks
Randall

assignment of contract

Hi,
I believe just put and/or assigns because the AOC will cover,Assignor and assignee.I was thinking if I was bringing the P&S to the party,In my contract would state;(without me adding and/or)I can re-assign this contract. If i were to buy from a lender...I would trust, corp or quick claim!

I do not know it all,But what i do know is because of you(newbies and inner circle)and the coaches make it real!
