There is no comparison to make. I just posted some of the docs that I use fr others to edit and make use of it they so choose to do so. The one's Dean have posted are just fine too.

the Contract to which the Addendum is attached (the "Back-Up Contract") is binding upon execution by the parties, and the earnest money and any Option Fee must be paid as provided in the Back-Up Contract. The Back-Up Contract is contingent upon the termination of a previous contract (the "First Contract") between Seller and Buyer for the sale of Property. Except as provided by this Addendum, neither party is required to perform under the Back-Up Contract while it is contingent upon the First Contract.

The Seller Option to Purchase can be used to spell out exactly how much of the monthly payment on the lease option will be going toward purchase and it also spells out the amount if any that the seller will be charging the buyer to exercise the option to purchase (option fee)

Contract for finder's fee

I would like to have investors sign a contract with me regarding finder's fee.

I will be referring the investor to my Realtor for properties that are in short sale or ones that are listed with real estate and I want to make sure that I get paid.

How would I word a contract for a finder's fee? I figured that I would have each of my investors sign one when I begin working with them. That way when I send the info on a property I already have a contract on file that they signed.

Any suggestions?

i would do...

something like a PROMISSORY NOTE type deal, of course you would need to list the terms of agreement too.

Does anyone know if colorado has any laws concerning the assignment of contracts. I have searched but can not find anything either way. I am imagining that there may be something that you have to get written permission from the seller first. Or does the contract take care of that when you check "this contract is assignable. Thanks


Non Circumvent Agreement and Promissory Note

Could anyone please post a NC Agreement and/or Promissory Note that they actively use with investors when doing bird dogging, wholesaling or just requesting a finder's fee. I would like to see what you use and i'm certain many others would enjoy the knowledge too.

Pls see below. I have used this confidentiality/non-circumvent agreement with investors which I modify each time to amend my fee structure depending which investor I am trying to work with. I found this agmt in the threads and just modified to my liking. Feel free to do the same. You can also google non-circumvent agreements. I suppose you can google promissory notes as well.

After this agreement is signed by my investor, I sign and provide the investor with the exact property location. This way he can begin doing his/her due diligence. If they proceed and eventually close, I get paid.

Confidentiality Agreement

It is understood and agreed to that the below identified discloser of confidential information may provide certain information that is and must be kept confidential. To ensure the protection of such information, and to preserve any confidentiality necessary under patent and/or trade secret laws, it is agreed that

1. The Confidential Information to be disclosed can be described as and includes:
Property description(s), technical and business information relating to proprietary addresses, contact information, real estate information, ideas, drawings and/or illustrations, costs, profit and margin information, finances and financial projections, customers, clients, marketing, and current or future business plans and any other information relating to property leads supplied, regardless of whether such information is designated as “Confidential Information” at the time of its disclosure.

2. The Recipient agrees not to disclose the confidential information obtained from the discloser to anyone unless required to do so by law.

3. This Agreement states the entire agreement between the parties concerning the disclosure of Confidential Information. Any addition or modification to this Agreement must be made in writing and signed by the parties.

4. If any of the provisions of this Agreement are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Agreement as a whole.

5. The Recipient acknowledges and agrees that if he/she decides to pursue purchase of property to be provided, that Recipient cannot close on said property without paying fee disclosed in item 6.stated below.

6. Whereby the Recipient agrees to pay Discloser a fee based on the schedule below, contingent on property closing. After said agreement is signed, Discloser will provide Recipient with address of said property.

Referral fees

Purchase price up to $400K $12,000
Purchase price for $400K and higher $18,000

WHEREFORE, the parties acknowledge that they have read and understand this Agreement and voluntarily accept the duties and obligations set forth herein.

I am putting in an offer to buy on contract for 1 year with the intent to fix up house and resale. Do you have a form for that?
