Shud I report a back stabbing Real Estate agent?

Last month I had a Realtor named Raul call me about a trashed 2 story ranch house. I got it on contract for 45K and flipped it for 57K and the deal went down fast in just under 3 weeks.

Last week my bird dog Jose finds another junker in the same town. I called the seller and she said they were hoping to get 35K for it. I was wondering how much to offer & sell it for and I sent the address to Raul to see if he cud get 40K for it. He lives in a nearby town about 20 miles away.

Raul said he wanted 4%. I offered him a flat fee of 2K & told him to add his fee on top of the 40K and he never replied back.

When I drove the 60 miles to the property a few days ago I walked the house and lot and built up my rapport with Joe the owner and offered 26K. Joe said that sounded good to him but he had to check with the boss. He calls his wife and puts me on the phone. I did my best to explain the bad condition and the money it wud take to repair it & ect ect. She was tough and we settled on 32k

I pulled out the contract to get a signature and Joe says he wants to wait till he gets a price from another buyer and pulls out Raul's colorful brochure and business card. I was shocked, I tell Joe, oh that's my guy Raul, we just did a big deal together a few weeks ago and I'm the one that sent him over here. Then Joe said "Oh, I didn't know he was your guy".
Well, I may burn for telling that partial lie.

I got the deal on contract and got it sold for 40K & already started escrow yesterday.
My bird dog Jose said he wud be happy with $1,500.

Anyway, I'm not going to report Raul to the Realtors Board, but I sure wont be trusting him. I have worked with a half dozen Realtor buyers for the last few years and none of them have ever tried going around me. I thought they had some ethics and rules to follow.
I got a little bit complacent.

Well if it happens once it will again

He needs to know that there are things called your word and ethics. If he will do that to you after you agreed on a flat fee he will burn someone else down the road if no one stops him. The next person could be a new investor and it could kill his dream.. We all know that feeling... I would vote to let him explain his actions to his broker....What's right is right and what's wrong is wrong

take him down... he deserves it. there is no feeling sorry in this case he is just plain wrong.....write a letter to the calif re commission also.

Get a copy of the California board of realtors ethics and code. Make a formal complaint and state which ethic/code he broke.

Go to his broker and inform him (because once their is a complaint and it is attached to a broker he will guide this agent in a better direction or direct him to the door)

If you do not want to make a big fuss.... Then
I would mention his name in Real estate Investment Clubs, reputation is very important and he should have been a man of his word

he should not continue in this way.

This is a prime example to be careful in vetting team members

You can't trust everyone

I wouldn't do business with someone like that any more. Like Keith said, if he did it once he would do it again later down the road. He might try to steal one of your buyers from you, cut you out of a big deal etc.

What you should of done is...

Used NCND form and have a GOOD rei attorney in case things go south

IT would have PROTECTED you

PPL suck and WILL do ANYTHING to cheat you for the sake of financial gain

Lesson Learned...maybe

IF you dont Know what NCND is, use the search box under Dean's chin and hit enter.

IF you have documents regarding deal with Raul, there is reprecussions and you can report him to the REA board....or threaten to and see if he plays along so YOU get paid

I think Joe was trying to jack you up on the price with the other buyer trick. Maybe you should get Raul' s version before you jump to conclusions.

I sent an email to Raul that I had this deal on contract and already sold for 40K I asked him what is going on, why did my seller have ur brochure and card and say he was waiting for ur offer.
Raul replied that he does investing also and he looks for distressed houses just like I do and I just happened to beat him to this deal.

I replied, well, it sure is a coincidence and suspicious that a few days after I send you the address to see if you cud sell it and offered you a flat fee of 2K that wen I meet the seller he has ur brochure and card. Your so tricky Raul. I'm a serious cash buyer and I've flipped 30 houses in the last year and you just lost all future deals. I have many investor friends.
You just F---ed up my friend.
And no reply since that email.
I have no doubts this slime ball Realtor was trying to steal my deal out from under me. I lost a few deals when I first started because of similar circumstances, but I had eliminated the bad eggs. A few I lost I did have on contract and buyers came in behind me to do their dirty work.
I've been working with some good people and just got complacent about sending out addresses b4 I got them locked up. But 99% of my interaction are good.
Time to batten down the hatches. Keep eliminating to bad dogs and get the word out. I'll stay positive, focused and keep finding those deals.

yea I would tell his broker like Keith so if he gets another complaint his broker might discipline him or there might be a record of it. But yea there are snakes in this biz unfortunately I have lost deals too bc of that.

But yea like you said too no more sending out addressed anymore unless you have it under contract. did you know about propertyradar.com? btw it is awesome, it is $50 a mo. but you get comps from it really good ones, you can do mailers, you can see which props have equity & are out of st owners etc.

it is a powerfull tool i recommend it i am using it & I dont need an agent anymore to send me comps i just use propertyradar. it is only in CA NV OR AZ tho for all other dg'ers in other states sorry, it will be nationwide eventually.

Take him down make him pay

Haha, my first reaction is to take him down and make him pay. Then I start thinking he's probably got a family and kids that depend on him.
Maybe me confronting him like I did gave him a wake up call.
I told him I have many friends that are investors and cash buyers and he just did a major screw up., I used harsher terminology though.
When somebody points out my mistakes and embarrasses me, that gets me motivated to change.,
