I'm so confused about all these contracts and what they mean... I don't really have the funds yet to approach an attorney about them.

Which contracts should I use for a straight buy with cash, with no intent to sell right now?

I dont even know how to fill them out, it's nuts lol

Agreement to purchase pdf

Take a look at the Agreement to purchase contract that Dean has under student resources. Print a copy and read over all of it. Start filling it out just to get the feel of it and before you know it you will get comfortable with contracts. Fill them out over and over for practice.

Do you mean YOU buying w/cash and holding the property? Then a simple purchase agreement (offer to purchase) is all you need.
Are you working with a RE agent? They will fill it out for you. If you're doing it yourself, you can use the one from the site, download a copy of your state-approved contract, or get one at an office-supply store. When I first filled one out, I cheated by looking at one that a realtor had filled out on a previous offer. Anita has a CA contract posted here for reference too.
Are you buying a listed or non-listed property?

One approach

One possible approach for you is the one I have been using and it has worked wonderfully.
I got signed up with the success academy and call them all the time.
With my current deal the seller wanted to use his contracts so I called the folks at the academy and asked them to look at them and perhaps let me know if they saw red flags. They were very helpful and while I waited they took care of me.
I typically call them and start the conversation with something like, I need bailed out again.

I have to say, if you are new to this they are one of the best resources you could have.

notarization - not that I know of

The purchase agreement is the basic outline of the the transaction and will be given to the title company, who will handle the actual transaction for you, along with title insurance, closing, title transfer, etc. At least that's how we do it here (WI), even FSBO.
The final HUD-1 Settlement statement will be the "official" document. Also, the deed which gets recorded.

I have done everything myself for some purchases/sales in the past, but would really recommend going through title/escrow company or RE attorney.

I thought about it for a second you should really let an attorney review it for you! Just for protection. It's a small fee to pay now but can save you later on any errors made on their part. Keep me posted.......Lubertha

I didn't want to just post another topic being so close to mine, spam up the thread, but anyways:

Another type of deal I was looking into is possibly with my credit lender is putting both of our names on the contract for the house... then filing a quitclaim deed. I put there name on the house so I can get financed through them. (can I do this)

I also wanted to write out a promissory note stating that the credit lender gets the house if I default, now I have no intentions to default, but can I do that even though the credit lender signed a quitclaim?? (Possible?)
